Bakersfield Underage DUI Defense Attorney

Juvenile & Underage DUI Defense Backed by Forensic Science

California’s zero-tolerance law means a driver under 21 can be arrested for underage DUI with a blood-alcohol concentration (BAC) of just 0.01%. No erratic driving is required, and no visible impairment is needed. A single traffic stop can trigger a one-year license suspension, and in some cases the vehicle is impounded and sold. For Bakersfield families, the window to act is narrow.

Whether your child faces a juvenile DUI charge or an adult criminal proceeding, the decisions made in the first days after arrest shape everything that follows. Middlebrook & Associates offers free consultations for families throughout Bakersfield and Kern County who need answers now.

Has your child been charged with an underage or juvenile DUI? Our Bakersfield DUI attorneys are ready to help. Schedule a consultation by calling (661) 874-1325 or completing our online contact form.

California’s Three-Tier Underage DUI Framework

California doesn’t apply a single standard to drivers under 21. Three separate statutes govern underage drinking and driving, and the BAC at the time of testing determines which charge applies and what penalties follow.

California Vehicle Code 23136: Zero Tolerance (0.01% BAC or Above)
Any detectable BAC of 0.01% or higher triggers an administrative license suspension for a driver under 21. This isn’t a criminal charge. It’s handled through a DMV administrative hearing, but the suspension is real and immediate.

California Vehicle Code 23140: Underage DUI Infraction (0.05% BAC or Above)
When a minor’s BAC reaches 0.05% or above, VC 23140 applies. It’s charged as an infraction rather than a misdemeanor, but it still carries fines and a one-year license suspension.

California Vehicle Code 23152: Standard Adult DUI (0.08% BAC or Above, or Drug Impairment)
A minor whose BAC reaches 0.08% or above, or who is impaired by alcohol or drugs at any BAC level, faces the full adult DUI charge under VC 23152, with full criminal penalties tried in adult court.

What a Conviction Means for Your Child’s Future

The legal penalties (fines, suspension, possible probation) are only part of the picture. A conviction goes on your child’s permanent criminal record, accessible to employers and colleges through standard background checks. Applications that ask about criminal history require disclosure, and that question appears on more forms than most families expect.

Many colleges and universities consider DUI convictions in both admissions decisions and financial aid reviews. A drug-related DUI can also affect federal financial aid eligibility, and private scholarships often conduct their own background reviews. The long-term reach of a conviction is one of the strongest reasons to fight the charge rather than accept a prosecutor’s first offer.

For minors under 18, cases are typically routed through juvenile court, where proceedings focus on rehabilitation and records may be eligible for sealing when the minor reaches adulthood. For those 18 to 20, the case proceeds in adult criminal court with standard criminal penalties. That distinction matters enormously for long-term consequences, and it’s one of the first things we assess in every underage DUI case we take on in Bakersfield.

Defense Strategies for Underage & Juvenile DUI Cases in Bakersfield

Richard Middlebrook holds the ACS-CHAL Forensic Lawyer-Scientist designation, a credential that reflects advanced scientific training in the evaluation of breath and blood test evidence. That foundation is directly relevant to underage DUI defense. The difference between a 0.01% BAC reading and an accurate one can determine whether a charge stands. Combined with a record of more than 250 DUI trials and a 97.4% historical success rate in Kern County courts, our legal team brings both scientific rigor and courtroom experience to every case.

While every juvenile DUI and underage DUI case turns on its own facts, common defense strategies include:

  • Lack of Probable Cause for the Stop: If police didn’t have a valid reason to pull your child over, the traffic stop may be unlawful and evidence from it suppressed, which may lead to dismissal of charges.
  • Faulty Field Sobriety Tests: Field sobriety tests are subjective and can be affected by nervousness, fatigue, or physical conditions unrelated to alcohol. Challenging their reliability is often a productive avenue.
  • Breathalyzer Accuracy: Breathalyzer machines must be properly calibrated and maintained. Failures in either are grounds to challenge the results.
  • Rising Blood Alcohol Content (BAC): Alcohol takes time to absorb into the bloodstream. A driver’s BAC may have been below the legal threshold while driving and risen above it by the time testing occurred. This is the “rising BAC” defense.
  • Medical Conditions: Certain conditions or medications can produce false-positive breathalyzer readings. Where applicable, this can be a valid defense.
  • Illegal Search and Seizure: Evidence obtained through an unlawful search may be suppressed under the Fourth Amendment.
  • Miranda Rights Violation: Statements made after arrest without proper Miranda warnings may be inadmissible in court.
